TERMS OF PROMOTIONAL ACTIVITY AND USE OF THE EKO SMILE CARD
The company “HELLENIC FUELS AND LUBRICANTS SINGLE MEMBER INDUSTRIAL AND COMMERCIAL S.A.” seated in Marousi Attica, 8A Cheimarras Street, 15125 (hereinafter referred to for brevity as “EKO SA”), is organizing a promotional activity (hereinafter the EKO SMILE Program) for the promotion of the Organizer’s products and services and in parallel for rewarding the customers of the stations for the sale of petroleum products, which are cooperating with it and have the signs used in Greece posted.
Those who wish to participate in the EKO SMILE Program shall obtain a special card (hereinafter the EKO SMILE card or Card) and they shall enjoy, according to the following terms, which regulate the EKO SMILE Program and the use of the EKO SMILE card (hereinafter the Terms), the determined from time to time privileges and the corresponding points from the purchase of specific products and services (hereinafter the EKO SMILE points), which they can subsequently use in order to procure the predetermined from time to time products and services under the more specific terms and conditions provided for these.
1. Right and Ways of Participation
1.1. Only the natural persons that have reached the age of 18, who are residents of Greece and who have legal capacity shall have a right to participate in the EKO SMILE Program and a right to possess the EKO SMILE card (hereinafter the Card holder).
1.2. The participation in the EKO SMILE Program and the use of the EKO SMILE card (which belongs to and remains in the ownership and occupation of EKO SA) is free of charge, and it can be realized in the following manners:
a] by those interested visiting the web page of the EKO SMILE Program www.ekosmile.gr, where they shall fill in the relative application in order to receive the EKO SMILE card in digital form.
The access of those interested to the internet is realized by their own technical means and at their expenses. EKO SA does not undertake any obligation with respect to ensuring, assisting the access to internet sites or providing facilitation to every interested party. The access to the web site of the EKO SMILE Program is permitted only under the terms of operation of the relative server and the technical and other conditions and specifications.
The access of those interested to the internet is realized by their own technical means and at their expenses. EKO SA does not undertake any obligation with respect to ensuring, assisting the access to internet sites or providing facilitation to every interested party. The access to the web site of the EKO SMILE Program is permitted only under the terms of operation of the relative server and the technical and other conditions and specifications.
b] by the interested parties downloading the relative EKO SMILE APP application and accepting in a supplementary manner the terms of use of this application, in order to receive the EKO SMILE card in a digital form.
c] by the interested parties visiting any of the petrol stations that participate in the EKO SMILE Program, where they shall receive the EKO SMILE card in a physical form.
2. Activation of the EKO SMILE Card
2.1. Every participant in the EKO SMILE Program can obtain only one EKO SMILE Card (either physical or digital), which he should connect necessarily to his mobile telephone number so that also by filling in the necessary information required he can activate it.
The activation of the EKO SMILE Card (either physical or digital) is realized either on the web page www.ekosmile.gr, or at the EKO SMILE APP application by filling in all the information required there (like indicatively personal information, mobile telephone number, email address, etc.).
Specifically and solely for the activation of the physical EKO SMILE Card, the facilitation for its completion is provided to the participant by two actions: a] In order to receive the Card from the filling station that shall participate in the EKO SMILE Program and to subsequently use it, the participant can fill in through the special application located at these filling stations certain only of the required information and specifically his full name, the date of his birth, his mobile telephone number, his email address and the acceptance of the terms of the EKO SMILE Program, of the Card’s use and of his personal data, b] at the latest within 180 calendar days from receiving the Card the participant should have filled in, either on the web page www.ekosmile.gr or at the EKO SMILE APP application, all the remaining required information, in order for the participant’s Card to be activated.
If the holder of a physical EKO SMILE Card does not fill in, for any reason, within the above 180 days, the remaining necessary information, which is required in order for the card holder’s registration to be complete and in order to complete the Card’s activation, his participation in the EKO SMILE program shall not be considered valid from the beginning and the card holder shall not be entitled to proceed e.g. to receiving any provision, privilege, gift, redemption of EKO SMILE points etc, and any eventual EKO SMILE points credited to the said Card shall be ipso jure deleted immediately following the lapse of the 180 days.

2.2. Upon the activation of the EKO SMILE Card, its holder unreservedly accepts the Terms of the EKO SMILE Program and of the use of the Card, as EKO SA reserves to eventually amend them at any time and unilaterally in the future and at the same time the holder assures EKO SA that all information of any nature, which the holder filled in, in order to render the Card’s activation possible, is true and actual and in addition that the holder is the beneficiary of his mobile telephone number and of his email address.
In the event that any inaccuracy or falsehood in the information that the Card holder states during its activation is ascertained at any time, EKO SA reserves the right to immediately cancel, retroactively from the beginning of the participation, unilaterally and without notification to the Card holder, his participation in the EKO SMILE Program, to delete all the SMILE points achieved until then, the privileges etc., which had been associated with this Card and the said holder, not excluding the claim on the part of EKO SA for damages for any (property, moral, incidental, consequential, etc.) damage that it shall sustain from the Card holder’s said behavior.
In the event that any inaccuracy or falsehood in the information that the Card holder states during its activation is ascertained at any time, EKO SA reserves the right to immediately cancel, retroactively from the beginning of the participation, unilaterally and without notification to the Card holder, his participation in the EKO SMILE Program, to delete all the SMILE points achieved until then, the privileges etc., which had been associated with this Card and the said holder, not excluding the claim on the part of EKO SA for damages for any (property, moral, incidental, consequential, etc.) damage that it shall sustain from the Card holder’s said behavior.
2.3. The Card holder is obliged to immediately notify by telephone during working days and hours to the EKO Consumer Service Line 18198 or 210 77.25.555 (Monday to Saturday, 7:00 am – 22:00 pm, with the exception of holidays) or through the EKO SMILE APP application or the web page www.ekosmile.gr every change of the information that he declared, otherwise EKO SA shall not be liable in the event of loss of correspondence and / or termination of the communication.
2.4. The Card holder is obliged to take all the advisable measures for the safe keeping of the Card or / and of the medium in which the digital Card has been stored and the Card holder is obliged to notify during working days and hours to the EKO Consumer Service Line at the telephone numbers 18198 or 210 7725 555 (Monday to Saturday, 7:00 am – 22:00 pm, with the exception of holidays) the loss of the physical Card or of the data of the digital Card or the loss / destruction / theft of the device with which the holder associated the digital Card or of the holder’s mobile phone, to which the holder connected the Card, in order for EKO SA to tend to the cancellation of the Card and to the issuance of a new Card, to which any eventual EKO SMILE points shall be transferred, as well as the data in general, which are associated with the previous Card.
EKO SA is not liable towards the Card holder for any kind of damage, loss or exchange of EKO SMILE points etc., which shall be eventually caused to the holder by the loss, destruction, theft, irregular use etc. of the (physical or digital) Card or of the medium in which the digital Card had been stored, until the notification of EKO SA on the part of the holder.
EKO SA is not liable towards the Card holder for any kind of damage, loss or exchange of EKO SMILE points etc., which shall be eventually caused to the holder by the loss, destruction, theft, irregular use etc. of the (physical or digital) Card or of the medium in which the digital Card had been stored, until the notification of EKO SA on the part of the holder.
2.5. The Card holder can revoke his participation in the EKO SMILE program by submitting a relative request to the EKO Consumer Service Center and following a successful verification of the information declared on his part during the Card’s activation.
Immediately after the completion of the revocation of the Card holder’s participation, all of the privileges, EKO SMILE points etc. achieved until then, which had been associated with this Card and the said holder, are deleted, not being able thereon to be transferred to any other card, to be redeemed with money, to be used for the procurement of a product or service etc.

3. Use of the EKO SMILE Card
3.1. The Card holder is entitled, following its successful activation, to use it in his transactions at the filling stations of sale of petroleum products cooperating with EKO SA, which have declared the participation in the EKO SMILE Program and which bear the relative sign (e.g. by signs, posters, flags, etc.) at the appropriate spaces of the filling station. The catalogue in force from time to time of the filling stations participating in the EKO SMILE Program and the use of the Card contained in the web page www.ekosmile.gr and in the EKO SMILE app application is possible.
3.2. Every Card holder is obliged to use it exclusively himself for their transactions and not to transfer or concede its use to another.
3.3 The Card holder has the right, from the actual purchases on his
part of the products from time to time that shall offer EKO SMILE
points, to include in the EKO SMILE Program up to two (2) transactions
per day & eight (8) (transactions) per month in order for his
participation to be valid and in order to receive the respective to
these transaction EKO SMILE points. For Heating Oil, it concerns to
actual purchases of 1.000 lt for the period of Heating Oil distribution without any limit of number of
transactions.
The Card holder’s transactions cannot be transferred to another time period different from the day when the relative transaction was realized, and those that exceed any of the above maximum limits shall not be validly included in the EKO SMILE Program, nor shall they provide EKO SMILE points to the Card holder, and any eventually inadvertently awarded points shall be immediately and ipso jure cancelled. The Card holder is obliged to proceed to actual and lawful transactions at the filling stations participating in the Program, and any invalidity, fictitiousness, alteration, etc. of any element of the transaction between the filling station owner and the Card holder, shall render the transaction at least invalid as to its participation in the EKO SMILE Program, it shall not credit the said Card with EKO SMILE points, etc., and any eventually credited points shall be ipso jure and retrospectively deleted by the Company, which reserves its right to request compensation also from the filling station owner as well as from the Card holder for any (property, moral, incidental, consequential, etc.) damage that it shall sustain from their behavior.

3.4. For every valid and actual transaction, which shall fulfill the conditions in order to be included in the EKO SMILE Program, the corresponding EKO SMILE points shall be immediately added to the Card holder’s account, either by the scanning of the physical Card by the filling station owner or by the declaration by the Card holder of the Card’s number or of his mobile telephone number, which he had registered during the Card’s activation.
The Card holder is obliged to check, immediately after every valid transaction, the accuracy and the correctness of the receipt’s data, which he receives from the filling station, as well as of the information of the awarded EKO SMILE points, so that, immediately and certainly before leaving the filling station, the Card holder can request the correction on the part of the filling station owner of any eventual incorrect entry on his part.
The Card holder is obliged to check, immediately after every valid transaction, the accuracy and the correctness of the receipt’s data, which he receives from the filling station, as well as of the information of the awarded EKO SMILE points, so that, immediately and certainly before leaving the filling station, the Card holder can request the correction on the part of the filling station owner of any eventual incorrect entry on his part.
3.5. The Card holder can at any time check the EKO SMILE points registered in his account on the application EKO SMILE APP or in his personal account on the web page www.ekosmile.gr or by phone during working days and hours at the EKO Consumer Service Line at the telephone numbers 18198 or 210 7725 555 (Monday to Saturday 07:00 am – 22:00 pm – with the exception of holidays).
EKO SA reserves the right to amend at any time the manner and the means of the Card holder’s information for the total of the EKO SMILE points that have been registered in his account.

3.6. EKO SA bears no obligation or liability towards the Card holder for any contractual or non-contractual relationship of the Card holder with the petrol station owner who transacted with him and who has been integrated to the EKO SMILE Program, as well as for any kind of compensation to the Card holder for any eventual default or irregular fulfillment of the said filling station owner’s obligation or / and for any tort of his.
4. EKO SMILE points collection
4.1. The Card holder shall receive:
a} one-off 100 EKO SMILE points immediately after the successful activation of the Card
b} 50 EKO SMILE points for every successful invitation of a third party, through the EKO SMILE app, for his participation in the EKO SMILE program, which points shall be credited to the account of the Card holder proceeding to the invitation solely when the person invited shall have successfully activated his own EKO SMILE Card and if, this person, upon the activation of his own card, shall have previously entered the unique referral code, which had been sent to the Card holder proceeding to the invitation upon the invitation. c} In his valid participations in the EKO SMILE program (as these have been determined above in the term 3.3):
• One (1) EKO SMILE point for each one (1) liter of EKO UNLEADED 95, Diesel EKONOMY procured
• Two (2) EKO SMILE points for each one (1) liter of EKO Premium 98, or Diesel Avio procured
• Three (3) EKO SMILE points for each one (1) liter of EKO Racing 100 procured
• Two (2) EKO SMILE points for each one (1) Kwh of charging procured
• Two (2) EKO SMILE points for each one (1) Euro of purchases value at the specially specified from time to time products from the petroleum stations bearing the special sign
• One (1) EKO SMILE point for each one (1) liter of LPG Autogas procured
• 0.5 EKO SMILE points for each (1) liter of heating oil procured. For the heating oil distribution period, it applies for up to 1.000 liters and a maximum transaction limit 3 (three).
As liter, for the calculation of each EKO SMILE point, solely the whole unit is taken into consideration, not calculating the decimals. The crediting of EKO SMILE points in any other manner (e.g. by their purchase in cash, credit card, other means of transaction) is prohibited, but solely by conducting the allowed actual and valid above transactions.
In the event of cancellation of any transaction, for any reason, which was included in the Card and for which the corresponding EKO SMILE points were granted to the holder, these shall be ipso jure deducted from the holder’s account.
EKO SA has the right, at its free judgment and at its discretion, to add or to remove products or services that shall participate in the EKO SMILE program for the determined by it, from time to time, time period, to change the EKO SMILE points corresponding from time to time to any product or service or / and to change the system of assigning EKO SMILE points per product.
4.2. EKO SA has the right, at its free judgment and at its discretion, to conduct at any time any promotional activities, contests and draws under the provided for from time to time terms, which shall be made public in any means or manner expedient, as well as the attribution of the provided for from time to time privileges, gifts, additional EKO SMILE points etc.
EKO SA has the right, as its free judgment and at its discretion, to extend, postpone, cancel or / and discontinue any such promotional activity, contest or draw and as a consequence in this case the relative additional EKO SMILE points shall not be attributed to the participants.
4.3. The EKO SMILE points, which are credited in the account of each Card holder, remain in force for 2 calendar years, which commence from the date of their acquisition, so that the holder proceeds to their consumption within this time limit. In the event that these points are not used following the lapse of 2 years, these shall be cancelled by EKO SA and shall be deleted from the holder’s account.
5. Members of the Group EKO SMILE PREMIUM and EKO SMILE PLATINUM
5.1. The Card holders, who, within twelve (12) calendar months, register in the Card valid transactions (as these are specified in the term 3.3 of the present terms) and who collect in total 2,000 EKO SMILE points from premium fuel, are included as members in the EKO SMILE PREMIUM Group.

5.2. The inclusion of a Card holder as member of the EKO SMILE PREMIUM Group or the EKO SMILE PLATINUM Group is valid for one calendar year from the day when the Card holder’s entry in this was achieved. If within this year the Card holder does not continue to register valid transactions, which are required for being maintained in his relative group, then, following the lapse of that year, he shall return to the basic EKO SMILE Program, not being entitled any more to any of the privileges / benefits of the EKO SMILE PREMIUM Group members or respectively of the EKO SMILE PLATINUM.
5.3. The members of the EKO SMILE PREMIUM Group shall enjoy the additional privileges/ benefits:
• 600 SMILE points upon their inclusion to the Premium level
5.3.1 The members of the EKO SMILE PLATINUM Group shall enjoy the additional privileges/ benefits:
• 1,000 SMILE points upon their inclusion to the Platinum level
• One free car wash (internal and external) per calendar year, which shall be provided solely at the petrol stations bearing the special sign
EKO SA has the right, at its free judgment and at its discretion, to amend at any time and to add and remove additional privileges to the EKO SMILE PREMIUM and EKO SMILE PLATINUM Group.
6. Redemption and consumption of EKO SMILE points
6.1. The Card holder has the choice to redeem the EKO SMILE points that shall be credited to his account, in order to obtain products from the EKO SA catalogue, which he can receive in a free form from the cooperating petrol stations or in digital form from the EKO Smile APP application or from the web page www.ekosmile.gr.
The EKO SMILE points are collected, kept and redeemed exclusively and solely according to everything determined in the present terms, as these are in force from time to time, prohibiting any other use, granting, sale or exchange of these or redemption of these with money or other products or services except for those provided for in the special EKO SA catalogue from time to time.
It is permitted to the Card holder to deduct from and to transfer the EKO SMILE points credited to his account through the EKO Smile app application, to the account of another holder of an EKO SMILE Card of the points that he wishes. Points transfer can be performed if the points balance
in the customer's profile is 500 points or more. The new point
balance after performing the transfer should be greater than or equal to 500.
6.2. Receiving a certain product from the catalogue in force from time to time can be exclusively realized either by the redemption of the EKO SMILE points provided for this product or by a combination of redemption of EKO SMILE points and the payment of the provided for price.
By the redemption of the EKO SMILE points that correspond to the acquisition of a certain product these are deducted from the Card holder’s account and their crediting anew to the account for any reason is not possible, except for the case were a special case of paragraph 6.5 of the present terms concurs. The products received are in no case exchanged with money or other products.

6.3. The Card holder is obliged, during the EKO SMILE points redemption procedure, to produce and to show to the petrol station also with the (physical or digital) Card any personal element necessary, from which his identity shall be proven, with the information declared during his Card’s activation.
6.4. In the event that the product that the Card holder received following the EKO SMILE points redemption has an actual proven defect, the filling station owner, from whom he procured it, is obliged to replace it with another free from the defect, pursuant to everything provided for in the applicable legislation. The Card holder is not credited or charged with new EKO SMILE points for the replacement.
6.5. EKO SA, in the event that the replacement of the product with the actual proven defect by another same product without the same defect is not eventually possible, as well as in any other similar case when it determines it as necessary, shall credit the Card holder with the EKO SMILE points that corresponded to the redemption of the product with the real defect, and the filling station owner from whom this product’s procurement was realized shall return to the Card holder the amount of money eventually paid on his part for the said product.
6.6 The Card holder has also the possibility to redeem EKO SMILE points at the seasonal offers, privileges, etc. from time to time, which EKO SA shall announce by any kind of means and manner of publication including always their notification by posting in the section “Gifts & Rewards” on the EKO SMILE APP application and on the web page www.ekosmile.gr. For these offers, privileges, etc. their terms and conditions made public from time to time shall apply, like indicatively the limited time offer, the limited stock of products being offered, etc.
The EKO SMILE points cannot be redeemed in combination with another kind of offer, promotion, discount, unless there is an explicit provision to the contrary in the relevant offers.

6.7 The Card holder is able to redeem EKO SMILE points in order to receive the respective digital and numbered coupon, by which he shall be able to acquire from the petrol stations bearing the special sign the product or the service at the price or with the discount and with the eventually more specific terms and condition mentioned on this coupon. The consumption of this digital and numbered coupon and the delivery of the relative product or service shall be realized at the filling station’s cash register by its scanning on the filling station’s special scanner or by typing its number without an identity check (as it is being realized in the other cases of EKO SMILE points redemption) and for this reason the Card holder is exclusively liable for the safe keeping of his coupons received or / and of the medium in which he has stored them, and EKO SA is not liable for the loss, theft or for the use and consumption of the coupon by any third party.

6.8. EKO SA does not bear nor does it undertake any kind of liability or obligation for the state in general, the quality, etc. of the products or for the eventual non-performance or irregular performance of the services that the Card holder shall receive by the redemption of the relative coupon, and everything related to the delivery, return, cancellation of the order, repair, reversal of sale, etc. of a product or service that shall be realized according to the relative policy of the petrol station in which the relative coupon was redeemed, against which the Card holder possesses the rights provided for by the applicable legislation.
7. General Terms
7.1. The participants in the EKO SMILE Program and the Card holders are obliged to act in good faith, legally, within the framework of the users and the practices of transactions, by observing the terms of the Program and of the Card, which are all equal and essential.
EKO SA has the right to exclude from the Program any participant / Card holder and to cancel his participation, as well as the EKO SMILE points that he may have eventually obtained, if it shall determine his action or behavior as illegal or abusive or unconventional.
The Card holder is obliged to immediately discontinue the Card’s use and to avoid any other illegal or abusive action of his. EKO SA reserves the right to claim compensation for any (property, moral, incidental, consequential, etc.) damage that it shall sustain due to the behavior of the participant / Card holder.

7.2. The EKO SMILE points that were not collected according to the Terms of the Program are ipso jure invalid and cannot be redeemed.
7.3. EKO SA reserves the right to cancel Cards and to delete the EKO SMILE points that have been credited to these, if a} these are inactive for a time period of more than 24 months, or b} in the event of a physical Card for which the EKO SMILE holder has not completed his necessary complete registration within 180 days from receiving it.
7.4. Every Card holder can be informed for the EKO SMILE points, as well as for any other promotional activity, gifts, offers, contests, etc. either through the web page www.ecosmile.gr or through the EKO SMILE APP application.
EKO SA reserves the right to personally inform the Card holder at its free judgment and in any manner of communication (e.g. email, sms, viber, etc. at the addresses, numbers, etc. that the holder has declared and to which he has consented during the Card’s activation for anything related to the Program, the Card, the EKO SMILE points that he has collected, for updates, gifts, offers, etc.
EKO SA reserves the right to personally inform the Card holder at its free judgment and in any manner of communication (e.g. email, sms, viber, etc. at the addresses, numbers, etc. that the holder has declared and to which he has consented during the Card’s activation for anything related to the Program, the Card, the EKO SMILE points that he has collected, for updates, gifts, offers, etc.
7.5. The participants / Card Holders do not have nor do they acquire any right at all on the trade marks, names, indications, symbols and other distinctive features and signs of EKO SA or / and of the filling station owners and the associates, and any amendment, publication, transmission, transfer, reproduction, distribution, presentation, connection, downloading or exploitation in other another manner, in whole or in part of these in any manner and by any means, is prohibited for any purpose, without the prior written permission of the right holder.
7.6. The Terms of the EKO SMILE Program and of the Card’s use are posted on the web page www.ekosmile.gr, and EKO SA reserves the right to amend them at any time, unilaterally and at its absolute discretion, as well as to proceed to a temporary interruption or suspension of the EKO SMILE Program by informing the participants / Card holders by posting on the web page www.ekosmile.gr or / and by any other appropriate means. Every Card holder is obliged to regularly visit the web page www.ekosmile.gr, in order to be informed with respect to the Terms of the Program and of the Card in force from time to time.
7.7. EKO SA reserves the right to discontinue at any time, without a penalty and without serious grounds, at its free judgment and at its discretion, the EKO SMILE Program, and in this case the Cards are immediately and ipso jure cancelled and all the EKO SMILE points are deleted from the account of all the Card holders, even if the 2-year time limit for their redemption has not lapsed.
7.8. For the processing of the Card holders’ personal data, data that are being collected within the framework of the EKO SMILE Program by EKO SA, if the participants accept the Terms of the EKO SMILE Program and of the Card, as well as the terms of use of the EKO SMILE APP application, you are kindly requested to refer to the EKO SMILE Privacy Notice located at the following link on the web page www.ekosmile.gr and to the respective terms of use of the application.
EKO SA also declares that for the security and the evidence of the transactions, the valid or invalid crediting of EKO SMILE points and in general for the correct and lawful observance of the Terms of the Program and of the Card, it may retain the history of transactions / movements that were realized by the Card’s use.
EKO SA observes the confidentiality of the personal data during their processing and has taken all the appropriate technical and organizational measures for preventing a breach of the personal data, with respect to the data that it is keeping and processing itself in its systems. Any loss of personal data or unauthorized access and use of the Card holders’ data, which does not take place through the systems of EKO SA and is not integrated in the sphere of its influence, but it is related to personal data exfiltration from the Card Holders in an illegal manner, like indicatively by the use of devices, networks, programs and other applications by the Card holders, (e.g. access of the Card holders through the internet to web pages where malicious software eventually exists, identity theft, phishing, pharming, cyber attacks) does not constitute the liability of EKO SA.

7.9. The Terms of the Program and of the Card are governed by the Greek Law. The courts of the city of Athens are competent for the resolution of any eventual dispute.
